On Saturday Platform X announced that it has decided to close down the office in Brazil from that date. It emerged after a sequence of orders from Brazilian Judge Alexandre de Moraes over the years.

He emphasised on the orders of the judge as the main cause of the sudden shut down of the platform. There were apparently the demands to delete some of the content of the site within these orders made.


Platform X’s action follows a report that Judge Moraes traveled to Brazil and threatened to arrest the legal representatives of companies if they failed to abide by content removal orders.


Nevertheless, Platform X stated to the users of Brazil that services of the office will be available to them all. That is why the platform remains committed to its user base in Brazil at the same level.


The move has raised controversy, for in the past Judge Moraes had sued the platform for purportedly enabling misinformation and hate speech.


Judge Moraes Allegedly Threatens X with Arrest Over Content Dispute; Platform Remains Active in Brazil


X has stated that Judge Moraes, a personality in the Brazilian Federal Supreme Court reportedly ordered one of its legal attorney to arrest. This was was attributed to the platform not respecting the law by withdrawing the contents as required by the law. Up to this date, the Supreme Court has not spoken about this situation directly.


As was said, the threat was made in secret and this made the issue more controversial. As for the specific details on the type of content under discussion, on the one hand, and the specific nature of the threat, on the other, X has not been forthcoming.


As a result of these occurrences, X insisted that bearing in mind that the firm is witnessing an elevated legal pressure, the services are still running in Brazil. This came after users of the platform raised worry over likely disruption of the company’s platform.


Still, there has been no direct word from Elon Musk who owns X and the developing situation. The management of this platform continues to be preoccupied with the legal issues arising out of alleged conduct by Judge Moraes.


There is impatience in the absence of response from the Supreme Court of Brazil; a number of questions remain unanswered. They are waiting for any changes or generally any comment on this issue from the court.


For now, it seems that the users in Brazil can continue to use the services of X without any implication. The platform plans to sustain its functioning and overcome the legal issues it has in the country.


Platform X’s Legal Battle: Musk vs. Judge Moraes Over Banned Accounts


Earlier this year, Judge Moraes undertook a serious movement against Platform X by ordering the suspension of some of the accounts that were involved in the dissemination of fake news and hate speech during the presidential administration of Jair Bolsonaro. This was as part of a wider probe into what has been termed as ‘digital militias’ active on the social media platforms.


The orders were to suspend accounts belonging to individuals, groups or organizations which acted as agents to promote Fake news and other radical activities. These measures were taken in order to counter the diffusion of toxic content which fared rampant under Bolsonaro’s presidency.


Further provocation arrived when Elon Musk started to unban banned accounts on X, essentially disregarding Moraes’ verdicts. This position made Musk to call the decisions by the Brazilian judge as “unconstitutional” a move that creatively caused debate and legal problems.


Finally, facing Musk’s challenge, the situation escalated and gained observers’ and, therefore, legal attention. The conflict between Musk and Moraes reflected the problematic of platform regulation and national law.
